Definitions

In these Terms and Conditions, "ph38", "we", "us", and "our" refer to the operator of the ph38 platform accessible at ph38.best. "You", "your", and "member" refer to any individual who registers or uses a ph38 account.

"Account" means the personal gambling account held by you on the ph38 platform. "Balance" means the total of deposited real-money funds and any credited bonus funds held in your ph38 account at any given time. "Bonus funds" means promotional credits issued by ph38 that are subject to wagering requirements before withdrawal. "Real funds" means money you have deposited from your own registered payment method.

"Wagering requirement" means the total amount of eligible play that must be completed before bonus funds or bonus-related winnings can become withdrawable. "Eligible games" refers to the games or markets that contribute toward a stated wagering requirement as set out in the applicable promotion. "PHP" or "₱" means Philippine peso.

Eligibility and Account Registration

• Individuals currently self-excluded from ph38 are prohibited from creating new accounts during any active exclusion period.

By completing registration, you confirm that you have read, understood, and accept these Terms and Conditions in full. If you do not agree with any part of these terms, you must not register or use the ph38 platform.

Account Security and Verification

You are solely responsible for keeping your ph38 login credentials — including your username, password, and any two-factor authentication code — confidential. ph38 support will never ask for your password at any time, through any channel. If someone asks for it, do not provide it and report the contact to us.

Any activity that occurs from your ph38 account is your responsibility unless you have reported an unauthorised access incident to ph38 support in writing before the activity takes place. ph38 will investigate reported incidents but cannot guarantee recovery of funds used without authorisation if credentials were shared or stored insecurely.

Know Your Customer (KYC) Verification

ph38 may require you to provide identity verification documents at any point after registration. This is a standard security measure and is required before processing withdrawals above stated thresholds. Acceptable documents include a government-issued photo ID such as a Philippine National ID, passport, SSS/GSIS ID, voter's ID, driver's licence, or similar valid identification.

Verification may also be requested when ph38 detects unusual activity, when a payment dispute arises, or when required by applicable regulations. Failure to complete verification within a reasonable time may result in account suspension and withdrawal restrictions until the process is completed.

Deposits

All ph38 deposits are made in Philippine pesos. You may deposit funds using the payment channels displayed in your ph38 account at the time of the transaction. Commonly available options include GCash, Maya, GrabPay, Coins.ph, InstaPay, PESONet bank transfers, BDO online banking, BPI online banking, UnionBank online banking, and supported Visa and Mastercard bank cards.

You must only use payment methods that are registered in your own legal name. Depositing through another person's account, wallet, or card is prohibited and may trigger an account review and withdrawal restriction. ph38 is not responsible for any fees charged by your payment provider.

• Minimum deposit amounts are displayed at the point of transaction and may vary by payment method.
• Deposits credited to your ph38 balance should be confirmed within the time shown for the selected method. If a deposit does not appear after the stated period, contact support with your transaction reference number.
• ph38 does not accept cash, cryptocurrency, cheques, or third-party transfers.
• Depositing constitutes your confirmation that the funds are not proceeds of illegal activity.

Withdrawals

You may request a withdrawal of your real-money balance at any time, subject to the following conditions. The minimum ph38 withdrawal amount is ₱200. Maximum single-transaction limits may apply depending on the payment channel and your account verification status.

Withdrawals will be processed to the same payment method used for your most recent qualifying deposit wherever possible. If that method does not support withdrawals, ph38 may ask you to verify an alternative account registered in your legal name. Processing times vary by payment channel and may extend during peak periods or when additional verification is required.

• Unfinished bonus wagering requirements may place a restriction on withdrawing associated funds until the requirement is completed or the bonus is forfeited.
• Identity verification must be complete before certain withdrawal amounts are released. ph38 reserves the right to pause a withdrawal request while verification is pending.
• ph38 may deduct applicable fees from withdrawal amounts where your payment provider charges for the transaction.

Bonuses and Promotions

General Bonus Rules

• Only one active bonus may be held at a time unless a promotion explicitly permits multiple active offers.
• A maximum stake rule applies while any bonus wagering is in progress. Placing a bet above the stated maximum may void the bonus and related winnings, even if the platform accepts the wager.
• Game contribution rates determine how much each eligible wager counts toward a wagering requirement. These rates vary by game category and are shown in the promotion terms.
• Bonuses expire if the wagering requirement is not met within the stated validity period. Expired bonus funds and any associated winnings will be removed from your account.

Bonus Abuse

Actions that ph38 considers to constitute bonus abuse include but are not limited to: opening multiple accounts to claim the same offer, using betting patterns designed to exploit a bonus rather than reflect genuine entertainment activity, and providing false information during registration to qualify for a new-player offer. ph38 may void the relevant bonus and winnings and may close the account if abuse is confirmed.

Casino and Fishing Games

Casino games and fishing games available on ph38 — including online slots, roulette variants, live table games, and fish shooting arcade titles — use certified random number generators (RNG) or live-streamed physical equipment to determine outcomes. Neither ph38 nor any player can influence, predict, or manipulate game outcomes in any way.

Each game displays its rules and paytable within the game interface. You are responsible for reviewing these rules before placing real-money wagers. Game return-to-player (RTP) percentages are theoretical averages calculated over a large number of rounds and do not represent a guaranteed return for any individual session or player.

• All bets placed in games are final once confirmed. Disconnection after a bet is placed does not cancel the wager; the result will settle normally according to the RNG outcome.

Prohibited Conduct

The following activities are prohibited on ph38. Engaging in any of the actions listed below may result in account suspension, account closure, forfeiture of all balances, and referral to relevant authorities where required by law.

• Registering more than one account on ph38 for any reason.
• Using false, fraudulent, or borrowed identity information during registration or verification.
• Depositing funds obtained through unlawful means, including proceeds of fraud, theft, or criminal activity.
• Depositing through payment accounts that do not belong to you.
• Using software, automated tools, bots, scripts, or exploits to gain an unfair advantage in any game or market on ph38.
• Colluding with other players to manipulate the outcome of any event or game.
• Attempting to exploit technical errors, pricing mistakes, or system vulnerabilities for financial gain.
• Sharing login credentials with any other individual or allowing another person to operate your ph38 account.
• Using the ph38 platform for any purpose other than personal entertainment gaming.

Account Suspension and Closure

ph38 may suspend or close any account at any time if we determine that these Terms and Conditions have been breached, if we are required to do so by a regulatory or legal authority, if we detect patterns consistent with fraudulent activity, or if we consider it necessary to protect the integrity of the platform or other members.

On suspension, access to the account and associated balance will be restricted pending investigation. On confirmed breach, any bonus funds, bonus winnings, and real-money amounts obtained through prohibited conduct may be voided. Any remaining real-money balance — where confirmed as legitimately deposited — will be returned to the original payment source after deduction of any amounts owed.

You may also request closure of your own ph38 account at any time by contacting support. If your balance contains uninvested real funds at the time of voluntary closure, a withdrawal to your verified payment method will be arranged. Bonus balances not yet released through wagering completion will be removed on account closure.

Responsible Gaming

ph38 does not guarantee that the platform will be available at all times without interruption. Scheduled maintenance and unforeseen technical events may temporarily affect access. ph38 will make reasonable efforts to restore service promptly and to communicate planned downtime in advance.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or wilful misconduct by ph38.

Privacy and Data Use

ph38 collects and processes personal information to operate and administer accounts, verify identity, process payments, prevent fraud, and comply with applicable laws. The types of data we collect, how we store it, who we may share it with, and your rights in respect of that data are set out in the ph38 Privacy Policy.

By registering a ph38 account, you acknowledge that you have read the Privacy Policy and accept its terms. The Privacy Policy forms part of the overall agreement between you and ph38.

Changes to These Terms

ph38 may update these Terms and Conditions at any time. When material changes are made, we will provide notice through the ph38 website and, where possible, via account notification. The effective date of each version will be displayed at the top of the document.

Continued use of the ph38 platform after an updated version of the Terms and Conditions has been published constitutes your acceptance of the revised terms. If you do not agree with any changes, you should stop using ph38 and request account closure before the effective date of the update.

Governing Law and Disputes

These Terms and Conditions shall be interpreted in accordance with the rules and regulations applicable to the ph38 platform's operating licence. In the event of a dispute arising from your use of ph38, you should first contact ph38 support and allow a reasonable time for the matter to be investigated and resolved.

ph38 will make a reasonable effort to resolve disputes fairly and within a reasonable timeframe. Any formal dispute that cannot be resolved informally may be referred to the relevant regulatory body or appropriate legal process. Neither party waives any legal rights they may hold by attempting informal resolution first.
